These Terms and Conditions ("Terms") govern your use of the HabariFupi website at habarifupi.com and the HabariFupi mobile application (collectively, the "Service") operated by HabariFupi ("we", "us", or "our").

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of them, do not use the Service.

1. Description of Service

HabariFupi is a news aggregation and summarisation platform that collects publicly available news articles from East African and international media outlets and presents AI-generated summaries to users. The Service is intended for informational purposes only.

2. Eligibility

You must be at least 13 years of age to use the Service. By using HabariFupi, you represent and warrant that you meet this age requirement. If you are under 18, you should use the Service only with the involvement of a parent or guardian.

3. Intellectual Property

3.1 Our content

The HabariFupi name, logo, user interface design, proprietary software, and AI-generated summaries are the intellectual property of HabariFupi. You may not reproduce, distribute, or create derivative works from these without our prior written permission.

3.2 Third-party content

Original news articles, headlines, images, and other media displayed through the Service remain the intellectual property of their respective publishers. HabariFupi displays summaries and links to original sources and does not claim ownership of underlying source material.

3.3 Fair use

Our use of news content is limited to brief summaries and attribution links to original sources, consistent with fair use and fair dealing principles applicable in East African jurisdictions.

4. Accuracy of Content

Article summaries are generated by artificial intelligence and may contain errors, omissions, or inaccuracies. HabariFupi does not verify the accuracy of source articles or AI-generated summaries. The Service is provided for general informational purposes and should not be relied upon as the sole source for any important decision. Always refer to the original source article for complete and accurate information.

5. Acceptable Use

You agree not to use the Service to:

• Scrape, crawl, or systematically download content without our written permission
• Circumvent, disable, or interfere with security features of the Service
• Transmit spam, malware, or other harmful code
• Impersonate HabariFupi, its staff, or any other person or entity
• Use the Service in any way that violates applicable local, national, or international law
• Attempt to gain unauthorised access to any part of the Service or its infrastructure

10. App Store Compliance

If you access the Service through our Android application downloaded from Google Play, your use is also subject to Google Play's Terms of Service. In the event of a conflict between these Terms and the applicable app store's terms, the app store's terms shall prevail solely with respect to the app store relationship.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
